Terms of Service
The agreement between you and Cascand.
Last updated September 16, 2026.
These terms are an agreement between you and Cascand, Inc. ("Cascand," "we," "us"), covering your use of the Cascand website and application (together, the "Service"). By creating an account or otherwise using the Service, you agree to these terms. If you are agreeing on behalf of a company, you are confirming you have the authority to bind that company, and "you" refers to that company.
1. What Cascand does
Cascand looks across a salesperson's connected systems and business context, decides what deserves attention next, and prepares the work around that decision: a drafted message, a proposed meeting time, or a suggested update to a customer relationship management record. Cascand does not send a message, book a meeting or invite anyone on its own, and changes to your customer relationship management records are proposed for your approval. If you connect one, an approved send or booking is also logged there as an activity. Every message, booking and invitation requires your explicit, one-click approval before it happens. Cascand's recommendations, drafts, and research are aids to your judgment, not a substitute for it, and you remain responsible for reviewing them before you approve anything.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use Cascand. You are responsible for the accuracy of the information you provide when creating an account, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us right away at sales@cascand.io if you believe your account has been accessed without authorization.
3. Your data
As between you and Cascand, you own the business and customer data you upload, import, or connect to Cascand ("Customer Data"). You give us a limited right to host, process, and use Customer Data solely to operate the Service for you, including to generate recommendations, drafts, and research, to secure and troubleshoot the Service, and to comply with law. We do not claim ownership of Customer Data, and we do not use it to train language models on behalf of anyone other than you.
Separately, Cascand owns the software, the recommendation engine, and the general, de-identified patterns it learns from operating the Service across our customer base as a whole, such as which kind of channel tends to get a faster reply in general. Those patterns never expose a specific customer's identity or specific business records to another customer.
You are responsible for having the right to provide us with any data you upload or connect, including data about your own contacts and customers, and for complying with any law that applies to that data.
4. Acceptable use
You agree not to:
- Use Cascand to send unlawful, deceptive, or unsolicited communications, or to violate applicable anti-spam law;
- Use Cascand to harass, defraud, or infringe the rights of any person;
- Attempt to gain unauthorized access to the Service, another customer's account, or the systems we use to run it;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as applicable law expressly permits;
- Resell or provide the Service to a third party as your own product without our written agreement; or
- Use Cascand's outbound-communication features after a recipient has opted out of hearing from you through Cascand.
5. Third-party systems you connect
Cascand's usefulness depends on the systems you choose to connect, such as your email, calendar, customer relationship management system, LinkedIn, or spreadsheets. Your use of those systems remains governed by your own agreement with their providers. You are responsible for having the right to connect an account and to authorize Cascand to act on your behalf through it, and for complying with each provider's own policies, including policies that govern automated messaging.
6. Fees and billing
Current pricing is posted at https://cascand.io/pricing. Cascand has no free trial. Once you subscribe to a paid plan, you authorize us to charge the payment method on file on a recurring monthly basis until you cancel, unless a separate written agreement says otherwise. Fees are billed in advance and, except as stated in our Refund and Cancellation Policy, are non-refundable.
You are responsible for any sales, use, or similar tax that applies to your purchase. Where required by law, we will calculate, collect, and remit applicable tax as part of your invoice, and it will be shown separately from the subscription fee.
7. Cancellation and suspension
You may cancel at any time from your account settings, or by contacting us; cancellation stops future billing and your access continues through the end of the period you already paid for. See our Refund and Cancellation Policy for detail.
We may suspend or terminate your access if you materially breach these terms, if your account is significantly overdue on payment, or if we reasonably believe continued access would create a legal or security risk to Cascand or others. Where practical, we will give you notice and a chance to fix the issue first.
8. No guaranteed results
Cascand helps you decide where to spend your attention and prepares work for your review; it does not guarantee any particular business outcome, including revenue, meetings booked, or deals closed. Recommendations and research are generated with the help of artificial intelligence and, like any such system, can be incomplete or wrong. You are responsible for reviewing anything Cascand prepares before you approve it.
9. Intellectual property
The Service, including its software, design, and documentation, is owned by Cascand and protected by intellectual property law. These terms do not transfer any ownership in the Service to you. If you send us feedback or suggestions about the Service, you agree we may use them without any obligation to you.
10. Confidentiality
Each party may receive confidential information from the other. Each party agrees to protect the other's confidential information with the same degree of care it uses for its own, and not less than reasonable care, and to use it only to perform under these terms.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, Cascand disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.
12. Limitation of liability
To the fullest extent the law allows, Cascand will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost revenue, arising from your use of the Service. Cascand's total liability arising out of these terms will not exceed the amount you paid Cascand in the twelve months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend and indemnify Cascand against any claim arising from your Customer Data, your use of the Service in violation of these terms, or your violation of a third-party system's own terms while connected to Cascand.
14. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules, except as superseded by applicable federal law. Any dispute arising from these terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to that jurisdiction.
15. Changes to these terms
We may update these terms from time to time. We will update the date at the top of this page, and for a material change, we will tell current customers directly before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
16. General
These terms, together with our Privacy Policy and any Data Processing Addendum you have signed with us, are the entire agreement between you and Cascand regarding the Service. If any part of these terms is found unenforceable, the rest remains in effect. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it.
17. Contact
